Terms & Conditions of Clearshot API

These terms and conditions (“Terms”) govern your use of the Clearshot API website and web app (the “Service”), a screenshot API solution provided by Clearshot API (“we” or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Service. 

Acceptance of Terms

By accessing or using the Clearshot API website or Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of an entity, you represent and warrant that you have the necessary authority to bind that entity to these Terms.

Copyright Information

The Clearshot API website and Service, including but not limited to its content, features, and functionality, are owned by Clearshot API and are protected by copyright and other intellectual property laws. All rights not expressly granted herein are reserved.

Intellectual Property

You acknowledge and agree that all intellectual property rights, including but not limited to copyrights, trademarks, trade secrets, and patents, associated with the Clearshot API website and Service are owned by Clearshot API or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

Subscription

  1. Subscription Plan: The Clearshot API Service is offered on a subscription basis. By subscribing to the Service, you agree to pay the applicable subscription fees as specified on the Clearshot API website or as otherwise agreed upon.
  2. Billing Cycle: The subscription fees are billed on a recurring basis according to the billing cycle chosen during the subscription process. The billing cycle may be monthly, annually, or as otherwise specified.
  3. Payment Authorization: By providing your payment information, you authorize Clearshot API to charge the subscription fees to the provided payment method. You represent and warrant that you have the necessary authorization to use the payment method.
  4. Automatic Renewal: Unless canceled in accordance with the “Termination” clause mentioned above, your subscription will automatically renew at the end of each billing cycle. You authorize Clearshot API to automatically charge the applicable subscription fees for the renewal period to the provided payment method.
  5. Fee Changes: Clearshot API reserves the right to change the subscription fees upon giving reasonable notice. Such notice may be provided through the Clearshot API website or by email to the email address associated with your account. Your continued use of the Service after any fee changes constitutes your acceptance of the new subscription fees.
  6. Taxes: You are responsible for any applicable taxes associated with the subscription fees, as required by law.
  7. Refunds: Subscription fees are non-refundable, except as required by applicable law or as expressly stated otherwise in these Terms.
  8. Account Suspension: Failure to pay the subscription fees may result in the suspension or termination of your account and access to the Service.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will immediately cease.

Limitation of Liability

To the maximum extent permitted by applicable law, Clearshot API and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  1. The use or inability to use the Clearshot API Service;
  2. Any conduct or content of any third party relating to the Service;
  3. Unauthorized access, use, or alteration of your transmissions or content;
  4. Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service;
  5. Any errors, inaccuracies, or omissions in the Service;
  6. Any loss or damage arising from the termination of your access to the Service;
  7. Any other matter relating to the Service.

This limitation of liability applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if Clearshot API has been advised of the possibility of such damages.

In no event shall Clearshot API’s total liability to you for all damages, losses, or causes of action exceed the amount paid by you, if any, for accessing or using the Service.

Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising under these Terms.

Allowed and/or Prohibited Uses

You agree to use the Service solely for lawful purposes and in accordance with these Terms. You are prohibited from using the Service to infringe upon any intellectual property rights, transmit or store any material that is unlawful, offensive, or harmful, engage in any fraudulent or misleading activities, or interfere with the proper functioning of the Service.

Disclaimers and Warranties

The Clearshot API Service is provided on an “as is” and “as available” basis, without any warranties or representations, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Service at your own risk.

Changes to Terms

We reserve the right to modify or update these Terms at any time, without prior notice. Any changes to the Terms will be posted on the Clearshot API website. It is your responsibility to review these Terms periodically. Your continued use of the Service after any modifications to the Terms constitutes your acceptance of the updated Terms.
